Choosing goods, services and classes

In short
Your mark is protected for the goods and services precisely listed in the specification, not for a class number. The 45 Nice classes (34 for goods, 11 for services) are used to organise these goods and services and to calculate fees.
Class and specification
- Class: a category of the Nice Classification, numbered 1 to 45.
- Specification: the precisely worded list of goods and services in each class.
- Ticking “class 25” is not enough: the specification (“clothing; footwear; headwear”) states what is protected.
The classification in force
The Nice Classification is administered by WIPO. It is revised every year (new version on 1 January). Offices use the version in force on the filing date. TMclass helps find terms accepted by European offices.
Examples by activity (for guidance only)
- Clothing: class 25 (clothing, footwear); possibly 35 for retail.
- Cosmetics: class 3 (cosmetics, perfumes); class 5 for certain pharmaceutical or hygiene products.
- Software: class 9 (downloadable software, apps); class 42 (software as a service, development).
- Consulting: class 35 (business management consulting); class 45 for legal services; 36 for financial advice.
- Restaurants: class 43 (restaurants, catering); 29/30 if you sell packaged food.
- E-commerce: class 35 covers retail services; goods sold under your brand must also be listed in their own classes.
Drafting well
A specification that is too broad may be challenged or later attacked for non-use; too narrow, it leaves activities unprotected. The Compliance and Comprehensive offers include validating or drafting the specification.

Does the price depend on the number of classes?
Yes for official fees, and depending on the offer for our fees (Essential: unlimited classes; Compliance and Comprehensive: 3 classes included).
Can I protect “all goods” in a class?
No. Offices require clear and precise terms.
Do the examples above suit my business?
Not necessarily. They are teaching aids, not a selection tailored to each case.
